Some of the grounds on which a marriage can be voidable according to section 5(1) of the matrimonial causes Act are as follows:
- Incapacity to consummate the marriage : This refers to the inability of one party to fulfill his or her sexual responsibility.
- Insanity/ unsoundness of mind: One of the spouses is mentally unstable
- Either party is suffering from a venereal disease that is communicable: The clean spouse has the right to void.
- The wife is pregnant for someone other than the husband: Can be void at the option of the husband.
